                                                                                                     General terms and conditions of the Sezamo for participation in the Sezamini Club

("Sezamo"), a limited liability company organized and operating in accordance with the laws of Romania, having its registered office at 5 Linia de Centură Street, Ctpark Industrial Park Bucharest North, Unit J2, Room C9.1F.26, Ștefăneștii de Jos, Ilfov County, registered at the Trade Register under no. J2024003334230, CUI RO50031526, share capital 45,000 RON (“Sezamo.ro”).

1. Scope

The General Terms and Conditions for participation in the Sezamini Club (Club Terms and Conditions) apply to the use of the Sezamini Club in the online shop of SEZAMO SRL
( „Sezamo.ro") on www.sezamo.ro (the “Magazinul Online Sezamo.ro”).

2. What is the Sezamini Club?

The Sezamini Club is a loyalty program for customers who are already registered with Sezamo (exp: customers who already have a customer account with www.sezamo.ro), which is aimed at expectant parents and parents of children between the ages of 0 and 12 ("Customers").

3. Contractual Partner

The owner of the online shop and contractual partner for all contracts is SEZAMO S.R.L. , a limited liability company organized and operating in accordance with the laws of Romania, having its registered office at 5 Linia de Centură Street, Ctpark Industrial Park Bucharest North, Unit J2, Room C9.1F.26, Ștefăneștii de Jos, Ilfov County, registered at the Trade Register under no. J2024003334230, CUI RO50031526, share capital 45,000 RON ("Sezamo"/”Sezamo.ro”)

4. Conclusion of the contract

If you register with the Sezamini Club, a contractual relationship is established between you and Sezamo.ro. Registration in the Sezamini Club is a prerequisite for participation in the Sezamini Club. Registration and participation are free and voluntary.

General terms and conditions of Sezamo.ro available here apply to the Sezamini Club, but are supplemented by the Sezamini Club Terms and Conditions, as set out below. In the event of any contradictions, the General Terms and Conditions of Sezamo.ro prevail.

5. Registration in the Sezamini Club and data processing

You can become a member of the Sezamini Club if you are a Sezamo.ro customer. We reserve the right to refuse the participation of certain persons or to exclude members. There is no legal right to ensure membership of the Sezamini Club. When registering for the Sezamini Club you must specify the first name of your child, the gender of your child and the date of birth. When registering, the intended parents only have to indicate the expected date of birth and – if known – the sex of the child. After the confirmation of your membership by Sezamo.ro (only then you are considered a subscriber) you will be notified by Sezamo.ro by email and your customer account will be expanded to include the Sezamini Club membership area. By entering your child's data, you confirm that you are authorized to transmit the data. Notifications from the Sezamini Club are sent to the e-mail address registered and stored in the customer account. The Member consents to be contacted by Sezamo.ro by email regarding campaigns and discounts or offers, including third-party content relating to the Sezamini Club. 6. Benefits of Sezamini Club

a. Permanent benefits

  • Free delivery, daily between 10:00 and 16:00. Free shipping applies for the standard one-hour delivery interval and for orders of at least 150 RON.
  • Exclusive discounts only for club members;

b. Discounts applicable for purchases of 300 RON or more

For any purchase of 300 RON or exceeding this amount, club members automatically receive the following benefits for a period of 14 days from the delivery of the order:

  • 10% discount on our own brands;
  • 10% discount on the entire assortment of BIO products;
  • access to exclusive products only for Sezamini members;
  • Free delivery intervals in 15-minute windows, daily between 10:00 and 16:00. Free shipping applies for orders of at least 150 RON.

For purchases over 300 lei, the additional benefits are automatically activated for 14 days. If the club members place another order worth 300 lei in the same month, the benefits are extended by another 14 days. Each calendar month, the extension of benefits is valid only once — basically, the additional benefits will be available for a maximum of 28 days during a calendar month, and this benefit will be reset during the following month for a new purchase of over 300 lei.

The discounts of the Sezamini Club are only available to members. Discounts are not transferable to other members.

7. Termination of membership

You can terminate your membership at any time, without giving reasons and without respecting a deadline in the "My Account" - "Sezamini Club" section. All acquired discounts and other club benefits are irrevocably forfeited when the account is closed and cannot be restored or transferred. We may close your account if you send us a request by email, with a notice period of four weeks. After the expiration of the four-week period, all discounts and other club benefits will irrevocably expire and cannot be reinstated or transferred.

Sezamo.ro reserves the right to discontinue the Sezamini Club at any time and without giving reasons or to replace it with another club. In the event of the dissolution of the Sezamini Club, all discounts, credits and other benefits that have been acquired as a member of the Sezamini Club will be irrevocably forfeited.

8. Privacy

Sezamo.ro's data protection declaration, available at https://www.sezamo.ro/articol/politica-confidentialitate, forms an integral part of these terms and conditions. Here you will also find detailed information about the processing of personal data and the rights of data subjects, as a member of the Sezamini Club.

9. Liability

We are liable to you in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of wasted expenses. In other cases, we are only liable – unless otherwise agreed – in the event of a breach of a material contractual obligation, the fulfilment of which is essential for the proper performance of the contract and the fulfilment of which you can regularly rely, limited to compensation for foreseeable and typical damage. In all other cases, our liability is excluded subject to the following clause.

Sezamo.ro does not guarantee the permanent availability of the technical systems in connection with the Sezamini Club. If the technical system for recording benefits in the form of credits of the Sezamini Club is not accessible (even temporarily), no complaints can be made against Sezamo.ro.

10. Applicable law, place of performance

If you are a consumer, you have the choice between your place of residence and the place of jurisdiction at the registered office of the company Sezamo.ro. The contracting parties agree, to the extent that there are no mandatory legal provisions to the contrary, the applicability of Romanian law. Mandatory consumer protection regulations under the law of the state where the consumer has his or her habitual residence remain unaffected.
