TERMS AND CONDITIONS OF THE SGR WARRANTY PACKAGING COLLECTION SERVICE

 

 

1. INTRODUCTION

1.1. The organizer of the SGR warranty packaging collection service (hereinafter referred to as the "Service") is SEZAMO S.R.L., headquartered in Stefanestii de Jos Village, Stefanestii de Jos Commune, Str. Linia de Centura, No. 5, unit J2 and warehouse extension in the BUN1 building (including parking), Room C9.1F.26, CTPark Bucharest North industrial park, Ilfov County, registered with the Trade Register under no. J23/3334/2024, having CUI 50031526, having Tax Identification Code RO50031526, hereinafter referred to as "Sezamo" or "Organizer".

1.2. This document sets out the terms and conditions ("Terms and Conditions") for the use of the Warranty Packaging Collection Service (SGR) offered by Sezamo. By using this Service, you accept and agree to these terms and conditions.

1.3. The service is carried out for an indefinite period.

1.4. The Organizer reserves the right to modify and/or supplement the Terms and Conditions during the course of the Service, as well as the right to suspend/terminate/interrupt the Service, but not before notifying the public in advance.

1.5. For public awareness, the Terms and Conditions are available, free of charge, to any interested person, on the www.sezamo.ro website or in the application, in the Terms and Conditions section.

1.6. According to the free decision of the Organizer, the Service may be publicized for the purpose of informing the public, including through advertising and/or informative materials.

2. DESCRIPTION OF THE SERVICE

2.1. Only persons who have reached the age of 18 with their domicile or residence in the delivery area of Sezamo, respectively the Municipality of Bucharest and Ilfov County (Voluntari, Balotești, Snagov, Afumați, Periș, Gruiu, Moara Vlăsiei, Ștefăneştii de Jos, Tunari, Otopeni, Mogoșoaia, Corbeanca, Ciolpani, Petrăchioaia, Grădiștea, Buftea, Chitila, Popești Leordeni and any other area available for delivery as can be identified on the Organizer's website) can benefit from the service.

2.2. Sezamo.ro offers a service of collection of packaging with guarantee (SGR) directly from the customers' homes. Through the Program, on the occasion of the delivery of an order made through the www.sezamo.ro platform or the Sezamo mobile application, Customers can return only SGR packaging to the Sezamo courier, regardless of whether they were purchased from the Sezamo platform or mobile application or from other merchants. Through the Service, on the first order containing products with guaranteed packaging (SGR) placed on the Sezamo.ro starting with the date of activation of the Service, customers receive a set of 10 special bags for the collection of guaranteed packaging, in which they can collect the returnable packaging with the SGR guarantee. The special bags for collection are transparent, have an individual volume of 60 liters and are provided with a system to be sealed.

2.3. "SGR packaging" and/or "SGR warranty packaging" or "warranty packaging" are by definition of the law non-reusable primary packaging made of glass, plastic or metal, with volumes between 0.1 l and 3 l inclusive, used for beer, beer mixes, alcoholic beverage mixes, cider, other fermented beverages, juices, nectars, soft drinks, mineral waters and drinking waters of any kind,  wines and spirits, which

bears the SGR mark in accordance with the applicable legislation and these Terms and Conditions. The following are not subject to the SGR: TetraPack packaging, jars, milk bottles, yoghurt bottles, plastic cups or beverage bottles, layered bag packaging, beverages in closed cardboard boxes and any other packaging that cannot retain its shape after emptying and that have not affixed the "guarantee packaging" symbol to the label.

3. COLLECTION PROCEDURE

3.1. Receiving the Recycling Bag

3.1.1. On the first order placed on the Sezamo.ro containing products with warranty packaging, customers receive a set of 10 special bags for collection free of charge.

3.2. Collecting Returnable Packaging

3.2.1. Customers must gather all warranty packaging in the special Sezamo bag, ensuring that they are completely emptied and have the shape and labels intact. We only accept packaging if it is collected in the special Sezamo bag, a 60-liter transparent bag customized with the Sezamo brand, which can be sealed. The bag must be clean both inside and out, with no spilled liquids.

3.2.2. The set of 10 bags of 60l, personalized with the Sezamo brand, transparent, sealable, non-reusable, can be purchased by customers from the www.sezamo.ro website and from the Sezamo mobile application. Bag characteristics: SEZAMO SGR Packaging Recycling Bags - 60l with closure ribbon (for recycling), 10 pcs/roll, 40 microns, 58cm x 67cm (LxW).

3.3. Delivery of returnable packaging

3.3.1. After filling the bag, it must be sealed and handed over to the courier at the next delivery, the customer will communicate to the courier the number of packages in the sealed bag.

3.3.2. The maximum quantity returned by a customer per delivery is determined by the size of the packages and is a maximum of  10 pcs x PET 2 liters or the equivalent in other types of smaller packaging, compared to a bag capacity of 60 liters.

3.3.3. At the moment, Sezamo couriers collect only 1 (one) bag per delivery.

4. SGR GUARANTEE

4.1. Sezamo Credits. Addition of appropriations
4.1.1. The courier will add the credits on the spot to the customer's account, credits that can be used on the next Sezamo order. The value of the loans granted is 0.50 RON/package with a returned guarantee. The accumulated credits can be viewed in the "Credits" section of the Sezamo account. In this case, 0.50 credits = 0.50 RON in the Sezamo customer account.

4.2. Use of appropriations
4.2.1. At the next order, before placing a new order, in the checkout area, customers can apply the accumulated credits to partially or fully pay for the cost of the shopping cart.

4.2.2. The credits received for the returned warranty packaging will be valid for 1 (one) year from the date of uploading to the Sezamo customer account.

4.3. Bank transfer of the SGR guarantee

4.3.1. Customers have the right to receive the amount of the guarantee by bank transfer. The bank transfer will be made at the request of the Clients, only with the consent of Sezamo and with the support of the bank commissions by the Clients, according to the legal provisions in force. For this method of refunding the SGR warranty, Customers will contact Sezamo's Customer Support service.

5. SPECIAL CONDITIONS

5.1. For the valid contracting of the Collection Service, the following conditions must be cumulatively fulfilled by the Client:

  • The packaging must have the SGR marking "Packaging with guarantee" affixed, respectively the representative symbol and the barcode are visible and legible;
  • The packaging must be completely emptied, undeformed, with the shape and labels intact.
  • We only accept packaging collected in the special personalized bag with the Sezamo brand, filled and sealed. The bag must be sealed by the customer before handing it over to the Sezamo courier;
  • The bag is clean both inside and out, with no spilled liquids;
  • Compliance with the fact that Sezamo collects only one bag per delivery.

6. FORCE MAJEURE AND UNFORESEEABLE CIRCUMSTANCES 

6.1. In any situation of force majeure or fortuitous event that prevents or delays, in whole or in part, the execution and continuation of the Service, Sezamo will be exonerated from liability for the fulfillment of its obligations for the period in which this fulfillment will be prevented.  

7. CHANGES TO THE TERMS AND CONDITIONS. INTERRUPTION, MODIFICATION, SUSPENSION AND TERMINATION OF SERVICE

7.1. Sezamo reserves the right to amend these terms and conditions at any time. Any changes will be communicated to customers through our website.

7.2. This Service may be interrupted, modified, suspended or terminated at any time if Sezamo decides. Sezamo also reserves the right to change the terms and conditions of the Service and will make this public. Any of the actions listed above will be brought to the public's attention in advance by publication on the Terms and Conditions page. 

8. PROTECTION OF PERSONAL DATA 

8.1. The Clients' personal data will be processed in accordance with Sezamo's personal data processing policy, available on www.sezamo.ro in the "Privacy Policy" Section https://www.sezamo.ro/articol/politica-confidentialitate.

8.2. The personal data of the Clients who will contract the Service will be processed for the organization and provision of the Service.

9. OTHER REGULATIONS 

9.1. In case of attempted or fraud of the system, abuse or any acts directed against and against Sezamo, it reserves the right to take all necessary measures to remedy the situation and hold accountable, under the conditions of the law, those responsible. Sezamo does not assume responsibility for the impossibility of contracting the Service due to software errors or due to causes that do not directly depend on Sezamo, such as technical failures of the internet service provider and so on.
