TERMS AND CONDITIONS – SEZAMO BARRIER-FREE

This document sets out the terms and conditions of Sezamo Barrier-free ("Terms"). It is a legal document that clearly describes the rights and obligations associated with the membership of the club – a free service for seniors aged 65+ and holders of disability or disability documents, which offers numerous benefits for shopping through the www.sezamo.ro online store ("Club" or " Sezamo Barrier-free Club").

Who are we and where can you find us?

The www.sezamo.ro e-shop is available via the www.sezamo.ro website or via the Sezamo.ro mobile application (the "Sezamo.ro Online Store").

The Sezamo.ro online store is the property of SEZAMO S.R.L., a limited liability company organized and operating in accordance with the Romanian legislation, with its registered office on 5 Linha de Centura Street, Ctpark Industrial Park Bucharest North, Unit J2, Room C9.1F.26, Stefanestii de Jos, Ilfov County, registered with the Trade Register under no. J2024003334230, CUI RO50031526, share capital RON 45,000 ("Sezamo.ro").

The terms are effective from August 15, 2025.

1. SEZAMO BARRIER-FREE

The Club is a free service available to customers who meet one of the following criteria:

You are 65 years of age or older, or
You have a valid official document regarding disability or disability.

The Club aims to make online shopping more accessible for those with reduced mobility or access to traditional shopping.

Membership is completely voluntary and free of charge.

2. BENEFITS OF MEMBERSHIP

What benefits do you receive as a member of the Club?

Free delivery and heavy food assistance

Free daily delivery between 10:00 and 15:00;
Minimum order value reduced to 100 Lei for delivery to the specified address (the current minimum value is mentioned in the Terms and Conditions of the Online Store Sezamo.ro);
Delivery to the door of your apartment, including upstairs and including buildings without elevator;
Assistance with the transport of heavy luggage is a standard part of the service.

Exclusive discounts at the Club

Access to special prices and offers that are not visible to regular customers;
Exclusive promotions for members.

Marketing Communications

As a member of the Club, you can receive offers, news and discount information from us by email or SMS.

You can opt out of marketing communications or adjust your preferences at any time through your customer account in the "Communication Settings" section or by contacting our customer service.

Important Note: Availability of benefits may vary depending on:

Delivery location and logistical capacity,
Current product offering,
The technical capabilities of the e-store Sezamo.ro.

Sezamo.ro reserves the right to modify, supplement or temporarily limit benefits, with members being duly informed.

3. HOW TO JOIN

Membership is activated in two simple steps:

Step 1: Register on the Online Store Sezamo.ro

First, register on the online store Sezamo.ro at www.sezamo.ro .

You can complete the registration:

Easily online via the website or mobile app, or
If required, by calling our free customer support line on 0800 894 077, where our team will be happy to assist you.

During registration, we collect personal data, including your name, address, phone number, and email address. This data is processed in accordance with our General Privacy Policy, which outlines the purposes, legal bases and retention periods.

Step 2: Join the Club

Once you have completed your registration on Sezamo.ro, simply call our customer support line on 0800 894 077 and we will register you for the Club. After successful registration, you can start shopping comfortably and enjoy all the benefits of the Club.

Can activation be temporarily unavailable?

In case of high demand that may affect the quality of services, Sezamo.ro may temporarily suspend new registrations. You will be informed in advance of any such limitation.

4. ELIGIBILITY CHECK

On the first purchase

The courier who delivers your first purchase will verify your eligibility for Club membership in one of the following ways:

For seniors/seniors – by visual confirmation of age or verification of an official identity document (identity card or passport),
For holders of a valid official document regarding disability or classification with a degree of disability – by checking the document proving the medical classification/condition.

Important: We do not store data from documents submitted during this check. The courier simply confirms to our customer support team that eligibility has been verified, and this confirmation is recorded in our system. This verification is done on the basis of the legal basis of the legitimate interest we have to ensure the correct use of the Club's benefits and no personal data is kept from the mentioned documents.

For future purchases

Eligibility will not be checked again for future purchases unless the courier has reasonable doubts about your eligibility.

5. TERMINATION OF QUALITY

Cancellation of membership

You can cancel your membership at any time and without giving a reason using any of the following methods:

Automatic termination of membership

Membership will automatically terminate if the customer account on www.sezamo.ro is deleted.

Cancellation of membership by Sezamo.ro

Sezamo.ro you can cancel your membership in the following cases:

If false information was provided during Club registration
If the Club's benefits are misused
If these Terms or the general terms and conditions of the online shop are Sezamo.ro breached

Consequences of cancellation

Upon cancellation of membership, all benefits of the Club will be terminated with immediate effect.

6. LIMITATIONS AND MISUSE

Personal nature of the benefits

The benefits associated with membership in the Club are:

Personal and related to a specific customer account,
Non-transferable to other persons,
Intended exclusively for the needs of the member and his household.

Prohibition of misuse

Misuse of Club benefits includes, in particular:

Providing false information about age or health status,
Commercial use of the benefits (e.g. purchase of goods for resale),
Any behavior contrary to the purpose of the Club.

Penalties for misuse

In the event of proven misuse, Sezamo.ro reserves the right to:

Immediately terminate your membership without compensation,
Block additional access to Club benefits,
Claim compensation for damages resulting from misuse.

7. LIABILITY AND WARRANTY

We operate the Club with the utmost care and effort to ensure the highest possible quality. However, there are circumstances that cannot be controlled by us.

Exclusion of liability

Sezamo.ro is not liable for:

The actions of other customers or circumstances that arise on their part,
Damage caused by force majeure (natural disasters, epidemics, government decisions, etc.),
Technical interruptions (power supply failures, network interruptions),
Interruptions or limitations of the Club's services due to extraordinary events,
Content and operation of third-party advertisements on the Online Store Sezamo.ro,
Unauthorized interference with the e-shop system by third parties.

Limited liability for third-party services

Sezamo.ro is not responsible for the services provided by payment service providers, couriers or other contractual partners. We are not responsible for any errors or failures on their part.

8. FINAL PROVISIONS

Legal context

If the provision of the Sezamo Barrier-Free Club service or any legal relationship resulting from the use of the Online Store Sezamo.ro involves an international (foreign) element, such relationship will be governed by Romanian law. Any disputes will be settled by the competent courts in Romania, based on the registered office of Sezamo.ro.

Relationship to other terms

Membership of the Club is also governed by the General Terms and Conditions of www.sezamo.ro. In the event of a conflict, these Terms will take precedence.

Supervision and authorisation

If necessary, you can lodge a complaint with the National Consumer Protection Authority, which is the national supervisory authority for consumer protection.

Termination of service

Sezamo.ro reserves the right to terminate the Sezamo Barrier-Free service or the sale of goods and services through the online store Sezamo.ro at any time.

Changes to the Terms

Sezamo.ro may reasonably modify or update these Terms. You will be notified in advance of any changes by email or another suitable method.

Separability

If any provision of these Terms is held to be invalid or unenforceable, it shall not affect the validity and enforceability of the remaining provisions. The invalid provision will be replaced by a provision that most closely reflects the original intent and purpose.

Data protection

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and local law. More details about how we process data for the Sezamo Barrier-Free in the dedicated Privacy Policy.
